Employee Consent Terms & Conditions

By clicking “Agree” or proceeding to access the Salary Advance service within LiaPay App, you (“Employee”) agree to the following Terms and Conditions. Please read carefully before proceeding.


1. DEFINITIONS

  • “Salary Advance” (also known as Earned Wage Access or EWA): A financial service that enables employees to access a portion of their already-earned salary before the official payday.
  • “Liabify”: The financial technology company facilitating Salary Advance services.
  • “Employer”: The company you are employed by, which has authorized salary deductions for Salary Advance repayments.
  • “Partner Institutions”: Third-party financial or technical service providers engaged by Liabify strictly for purposes necessary to administer, fund, process, or support the Salary Advance service, including but not limited to Mawarid Finance, Paymentology, and others as required for service delivery.

2. NATURE OF SERVICE

Liabify acts as a financial technology service provider facilitating early access to wages earned by employees. Liabify does not provide banking services, lending, credit facilities, deposit-taking services, or any regulated financial services.

Salary Advance enables employees to access a portion of wages that have already been earned but have not yet been paid. The Service does not constitute a loan, credit facility, financing arrangement, or extension of credit.

Repayment is limited strictly to the amount of wages earned, together with any applicable service fees. No interest is charged. Nothing in these Terms shall be construed as creating a debtor-creditor relationship beyond the settlement of accessed earned wages and applicable service fees.

3. ELIGIBILITY

To access and use the Salary Advance service, you must:

  • Be at least 18 years of age.
  • Be employed by a company that has partnered with Liabify or its affiliates.
  • Have a valid employment contract and a salary bank account in your name, linked to your payroll.

Liabify reserves the right to verify employment, salary data, and payroll integration status at any time to confirm ongoing eligibility.

4. SERVICE CONSENT

By opting into Salary Advance, you acknowledge and agree that:

  • You authorize Liabify to process your earned salary access requests via the LiaPay app.
  • You understand that this is a non-loan, non-credit product, and simply early access to wages already earned.
  • You understand that Salary Advance eligibility, limits, and availability are subject to Employer participation, payroll integration, and internal risk assessments.
  • Liabify reserves the right to approve, decline, suspend, or limit any request at its sole discretion based on operational, compliance, or risk considerations.

5. RIGHT TO SUSPEND OR BLOCK ACCESS

Liabify may immediately suspend, restrict, or terminate access to the Salary Advance service without prior notice where:

  • (a) Fraud, misuse, or suspicious activity is suspected;
  • (b) False, inaccurate, or misleading employment or salary information is detected;
  • (c) Employer payroll participation is suspended or terminated;
  • (d) Required compliance or verification checks cannot be completed;
  • (e) Required under applicable law or regulatory instruction.

Suspension shall not affect any outstanding repayment obligations.

6. SALARY DEDUCTION AUTHORIZATION

By accepting these Terms, you are expressly and voluntarily and irrevocably authorizing your Employer to deduct from your end-of-month salary an amount equal to the Salary Advance amount disbursed to you together with any applicable service fees.

6.1 Priority of Deduction

Your Employer shall apply the authorized deduction as a priority payroll deduction and process such deduction before releasing or paying the remaining net salary balance payable to you for the relevant payroll period.

6.2 Continuing Authorization

Your acceptance constitutes a continuing written authorization to your Employer to process salary deductions for each Salary Advance transaction requested by you, without requiring additional written consent for each request.

6.3 No Further Consent Required

No additional written or electronic consent shall be required for each subsequent Salary Advance request once these Terms have been accepted.

7. DATA ACCESS AND SHARING CONSENT

You explicitly authorize the following:

7.1 Access to Personal Data

By signing up for the LiaPay application, you acknowledge and consent to Liabify Technologies collecting, storing, accessing, and processing your personal and employment-related information (including data collected from their employers and the LiaPay app) either directly from you or through your employer. This may include, but is not limited to:

  • Full name, nationality, mobile number, Emirates ID.
  • Salary details and employment history.
  • Attendance records and bank account information.
  • Payroll activity, leave balances, and WPS history.
  • Any additional HR or financial data necessary to provide or assess Salary Advance eligibility.

7.2 Data Sharing with Partners

You grant consent for Liabify to securely share your personal and payroll-related data with its authorized partners, including but not limited to:

  • Mawarid Finance: For credit worthiness assessment, transaction processing and data automation.
  • Paymentology: For payment facilitation and disbursement infrastructure.
  • Other future partners (e.g., insurance, travel agencies) as necessary for service enhancement, subject to strict data protection.

These parties may process your data strictly for the purpose of administering and maintaining your Salary Advance benefit.

In addition to the partners listed above, you acknowledge and agree that Liabify may engage with future partners as necessary for the provision and enhancement of services. These future partners may include, but are not limited to, online and offline merchants, marketplaces, lenders, financial institutions, real estate companies, insurance providers, healthcare organizations, mortgage providers, vehicle loan providers, and travel agencies. Any such sharing will remain subject to strict data protection, confidentiality, and purpose limitation obligations.

7.3 Storage and Retention

Your data will be stored securely and retained only as long as necessary to fulfill regulatory obligations and service operations.

8. USER ACCOUNTS & SECURITY

To access certain features, you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials.

Liabify shall not be liable for any loss arising from unauthorized access resulting from your failure to safeguard such credentials. You agree to notify us immediately of any unauthorized use of your account.

In addition, the Salary Advance service is strictly personal to the registered Employee. You may not assign, transfer, or allow any third party to access or use your account. You are responsible for safeguarding your login credentials.

9. INTELLECTUAL PROPERTY

All content on our website and applications (including text, graphics, logos, and software) is the property of Liabify International Operations Holding Limited or its licensors. You may not copy, distribute, or modify any content without our prior written permission.

10. COMPLIANCE WITH UAE DATA PRIVACY LAWS

We comply with the UAE Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data (PDPL). This means:

  • Your data will only be used for clear, lawful purposes related to our services.
  • We apply strict security measures, including encryption and access controls, to protect your information.
  • You have the right to access, update, or withdraw your consent for data processing at any time (see Clause 14 EMPLOYEE RIGHTS and Clause 15 RIGHT TO WITHDRAW).

11. SERVICE FEES AND TRANSACTION LIMITS

  • Fees: The Salary Advance service may include a processing fee, as clearly shown in the online request process before confirming a request. No interest is charged.
  • Limits: The maximum Salary Advance amount you may request per month shall not exceed 50% of your earned salary, subject to employer approval and internal policies.

12. NO IMPACT ON CREDIT SCORE

This service is not reported to credit bureaus and does not affect your credit score. It is solely a non-credit salary access service.

13. CORRECTION OF ERRORS

Liabify reserves the right to correct system errors, manifest errors, duplicate disbursements, or payroll miscalculations.

You authorize Liabify and your Employer to deduct any incorrectly disbursed amount from subsequent salary payments or to request direct repayment where necessary.

14. EMPLOYEE RIGHTS

You have the right to:

  • Request a copy of your data held by Liabify or its partners.
  • Ask for corrections to inaccurate data.
  • Revoke this consent, subject to notice, by contacting: support@liabify.com or calling +971 58 275 2367.

15. RIGHT TO WITHDRAW

You may opt out of the Salary Advance service at any time by submitting a written request to HR or Liabify support.

Withdrawal applies only to future Salary Advance requests. Any outstanding Salary Advance amounts already disbursed will continue to be deducted from your payroll or final settlement.

Upon withdrawal, no further deductions will occur for future transactions, and your data will not be shared for new processing beyond the withdrawal date, except as required by law or regulatory compliance.

16. EMPLOYMENT TERMINATION OR FINAL SETTLEMENT

In the event of resignation, termination (with or without notice), unpaid leave, salary suspension, or end-of-service settlement prior to full repayment:

  • (a) You authorize your Employer to deduct any outstanding Salary Advance amounts from your final settlement.
  • (b) Liabify reserves the right to pursue lawful recovery methods under UAE law.

Your repayment obligations survive termination of employment or termination of this Agreement.

In the event payroll deduction is insufficient or unavailable, you remain personally liable for repayment and agree to repay such amounts upon demand.

17. INDEMNITY

You agree to indemnify and hold harmless Liabify, its affiliates, officers, directors, and partners from claims, losses, damages, or expenses arising from:

  • (a) Inaccurate information provided by you;
  • (b) Breach of these Terms;
  • (c) Disputes between you and your Employer regarding payroll deductions.

18. LIMITATION OF LIABILITY

You acknowledge and agree that:

  • Neither LiaPay nor Liabify shall be liable for delays caused by technical failures, employer non-compliance, or banking issues.
  • Liabify shall not be liable for indirect, consequential, special, incidental, or punitive damages, including salary delays caused by Employer actions, WPS disruptions, or banking system failures.
  • Your Employer is solely responsible for deducting and remitting the amounts as authorized herein.

19. FORCE MAJEURE

Liabify shall not be liable for delay or failure resulting from events beyond its reasonable control, including regulatory actions, system outages, cyber incidents, banking disruptions, or acts of government.

20. AMENDMENTS

Liabify may amend these Terms by providing at least fifteen (15) days’ prior notice via in-app notification or email. Continued use of the service constitutes acceptance of the amended Terms.

21. ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and Liabify regarding the Salary Advance service and supersede all prior representations, communications, or understandings.

22. SURVIVAL

Provisions relating to repayment, salary deduction authorization, indemnity, limitation of liability, data processing, dispute resolution, and governing law shall survive termination of employment, suspension of service, or termination of this Agreement.

23. GOVERNING LAW & JURISDICTION

These Terms & Conditions are governed by the laws of the Dubai International Financial Centre (DIFC) and the United Arab Emirates.

Any legal disputes arising from these terms shall be resolved exclusively in the courts located in the United Arab Emirates.

24. ACCEPTANCE

By clicking “Agree & Proceed”, you confirm that:

  • You have read, understood, and accepted these Terms & Conditions;
  • You voluntarily authorize salary deduction for Salary Advance repayment;
  • You consent to the processing and sharing of your data as stated above.

If you do not agree, please do not proceed with the service. You may continue using the LiaPay app for other HR functions.
